Terms of Service

1. ACCEPTANCE OF TERMS

These Terms of Service ("Terms") govern your use of the Pave mobile application and website at pave.fit ("Service"), operated by Pave ("we", "us", "our"). By creating an account or using the Service, you accept these Terms.

2. ELIGIBILITY

You must be at least 13 years old to use Pave. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms.

3. ACCOUNTS

• You are responsible for maintaining the security of your account.
• You are responsible for all activity that occurs under your account.
• You must provide accurate information when creating your account.
• You may not share your account with others.

4. ACCEPTABLE USE

You agree not to:

• Submit false, fabricated, or spoofed GPS data
• Use bots, scripts, or automation to claim streets
• Attempt to circumvent speed checks or other anti-cheat measures
• Harass, abuse, or harm other users
• Reverse engineer, decompile, or disassemble the app
• Use the Service for any unlawful purpose

We reserve the right to suspend or terminate accounts that violate these rules without notice.

5. STREET OWNERSHIP AND GAME MECHANICS

Street ownership in Pave is virtual and has no real-world legal meaning. Owning a street in the app does not grant any rights over that physical road. Ownership can be transferred to other users at any time when they complete an activity on that road. We make no guarantees about the persistence of any ownership status.

6. THIRD-PARTY INTEGRATIONS

Pave integrates with Strava, Garmin, Apple Health, and Google Health Connect. Your use of those platforms is governed by their respective terms of service. We are not responsible for the availability or accuracy of data provided by third-party services.

Activity data sourced from Garmin devices is displayed with Garmin attribution as required by Garmin's API terms of service.

7. GPS AND LOCATION DATA

The Service requires GPS location data to function. You grant us a license to process your location data to provide the Service as described in our Privacy Policy. You can configure privacy zones to exclude certain locations from processing.

8. USER CONTENT

Your display name and profile color are visible to other users. By choosing a display name, you grant us a license to display it within the Service. You are responsible for ensuring your display name does not infringe on third-party rights or violate these Terms.

9. INTELLECTUAL PROPERTY

The Pave app, logo, and all related content are owned by us and protected by copyright and trademark law. You may not use our branding without prior written permission.

10. DISCLAIMERS

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. USE THE SERVICE AT YOUR OWN RISK.

Pave is a gamified fitness app. Do not engage in dangerous behavior while using the app. Always follow traffic laws and prioritize your safety.

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS OF DATA.

12. TERMINATION

You may delete your account at any time from the app settings. We may suspend or terminate your account at our discretion if you violate these Terms. Upon termination, your right to use the Service ceases immediately.

13. CHANGES TO TERMS

We may update these Terms from time to time. We will notify you of material changes via the app or email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. GOVERNING LAW

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction.
